WEBSITE USER AGREEMENT

Scope of Service and Terms of Use

This Website User Agreement (the "Agreement") has been entered into between Symbolwatches and the User who accesses and/or becomes a member of www.symbolwatches.com (the “Website”), concerning the User's use of the Website, at the moment it is accepted by the User in the electronic environment in which the Website operates. All rights of use and disposal over the Website belong to Symbolwatches.

By accessing and/or becoming a member of the Website, the User accepts and declares that they have read the entire User Agreement, fully understood its content and approved all of its provisions, and that they will act in accordance with the other conditions set out on the Website and with the legislation in force.

The services provided by Symbolwatches through the Website consist, in general, of electronic commerce as defined in consumer protection legislation. Within the scope of using the Website, Users hold a "password" of their own choosing. The email address entered by the User during registration is personal to the User and allows the creation of a single membership; two different Users cannot be created with the same email address. The "password" is known only to the User. The User may change their password at any time. Choosing and protecting the password is entirely the User's responsibility. Symbolwatches accepts no responsibility for problems arising from the use of the password.

Symbolwatches may amend these terms of use whenever necessary. Such amendments are published on the Website from time to time and take effect from the date of publication. Every natural and legal person who benefits from the Website's services and accesses the Website is deemed to have accepted in advance every amendment made by Symbolwatches to these terms of use.

Rights and Obligations

Symbolwatches reserves the right to change the information, forms and content on the Website, or to be added to it, at any time.

To become a member of the Website, you must be at least 18 years of age and must not have been temporarily suspended or permanently banned from membership by Symbolwatches.

Users may carry out transactions on the Website only for lawful and personal purposes. Users bear sole legal and criminal liability for every transaction and action they perform on the Website.

Symbolwatches accepts no liability for any interruption of a transaction, error, omission, interruption, deletion, loss, delay of a transaction or communication, computer virus, communication failure, theft, destruction, or unauthorised access to, alteration or use of records, whether arising from breach of the Agreement, tort, negligence or any other cause.

Symbolwatches may use the information submitted to it by Users through the Website in accordance with the "Privacy Policy" and the provisions of the Agreement, and may process this information and classify and retain it in a database. Symbolwatches may also use information such as the User's identity, address, email address, telephone number, IP address, the sections of the Website visited, domain type, browser type and the date and time of the visit for purposes such as statistical evaluation, announcing campaigns and providing personalised services.

Users accept, declare and undertake that the information and content they provide on the Website is accurate and lawful. Symbolwatches is neither obliged nor responsible to verify the accuracy of the information and content submitted to Symbolwatches by Users or uploaded, modified or provided by them through the Website, nor to undertake and guarantee that such information and content is secure, accurate and lawful, and it cannot be held liable for any damage arising from such information and content being incorrect or erroneous.

Intellectual Property Rights

All information, texts, images, trademarks, slogans and other signs on this Website, together with the programs for protecting information relating to other industrial and intellectual property rights, the page layout and the presentation of the Website, and all Intellectual Property rights therein, are the property of Symbolwatches. The partial or complete copying, modification, publication, transmission via online or other media, distribution or sale of the information on this Website or of any database, website, software code, HTML code and other code relating to the Website pages, and of the products, designs, images, texts, visual and audio images, video clips, files, catalogues and lists contained in the Website, is prohibited. Users accept and undertake that they will not reproduce, copy, distribute or process the Website software, hardware and content listed above (without being limited thereto), and that they will not, through these actions or by any other means, enter into direct and/or indirect competition with Symbolwatches. The User has no right to resell, process, share, distribute or display Symbolwatches' services, information and copyrighted works, or to allow others to access or use Symbolwatches' services. The partial copying, printing, processing, distribution, reproduction or display of the information on this page is permitted only for non-commercial personal needs and with the written permission of Symbolwatches.

Assignment

Symbolwatches may assign this Agreement, in part or in full, at any time without notice. The User may not assign their rights and obligations under the User Agreement, in part or in full, to any third party without the written consent of Symbolwatches.

Force Majeure

In all circumstances legally deemed to be force majeure, Symbolwatches shall not be liable for the late performance or non-performance of its obligations arising from this Agreement. Such circumstances shall not be deemed delay, non-performance or default on the part of Symbolwatches, and Symbolwatches shall have no obligation to pay compensation in respect of them.

Governing Law and Jurisdiction

Disputes arising from this Agreement are subject to Turkish Law, and the Courts and Enforcement Offices of Istanbul shall have jurisdiction.

Termination of the Agreement

This Agreement shall remain in force and continue to produce its effects between the Parties for as long as the User accesses and/or is a member of the Website. It shall be deemed terminated upon expiry of the User's membership or the temporary or permanent suspension of their membership. Symbolwatches may unilaterally terminate the User Agreement if Users breach this User Agreement and/or similar rules on the Website relating to membership and services, and Users shall be liable to compensate all direct or indirect damages incurred by Symbolwatches as a result of the termination.

This Website User Agreement enters into force on the date it is published on the Website by Symbolwatches. Users are deemed to have accepted the provisions of this Agreement by using the Website.
